User Agreement Introduction:
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all the legal implications arising from your use of the store's services through this online platform. Any person's use of the Jovial store, whether as a consumer of a service, product, or otherwise, constitutes their acceptance and agreement, with full legal capacity, to all the terms and conditions of this agreement. This agreement confirms your commitment to its terms and conditions. This agreement applies to all types of transactions between the user and the store. This agreement becomes effective and binding upon your acceptance and registration with the Jovial store, in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1 - Introduction and Definitions:
The above preamble is an integral part of this agreement. Below are the definitions of the key terms used in this agreement:
1. (The Store) This term refers to the Jovial Store, and this definition includes all forms of the Jovial Store on the internet, whether it be a mobile application or a page on any social media platform.
2. (The User) This term refers to any consumer who purchases a product or service from the Store through its online platform.
3. (The Agreement) This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article 2 - User's Legal Capacity:
1. The user acknowledges that they possess the legal capacity, as recognized by Sharia and applicable laws, to transact with the Store, or that they are at least eighteen years of age.
2. The user agrees that in the event of a violation of this article, they shall bear the consequences of such violation before third parties.
Article Three - Nature of Jovial Store's Obligation:
1. Jovial Store's obligation to consumers or users is to provide the (service or product).
2. Jovial Store may provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the user.
Article Four - Jovial Store Usage Guidelines:
1. The user is obligated to use the Jovial Store's electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product from Jovial Store, the user is obligated not to use that service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article Five - Accounts and Registration Obligations:
Upon applying for membership in Jovial Store as a user, you are obligated to disclose information for use when accessing Jovial Store's services. By agreeing to the following:
1. Jovial Store is responsible for maintaining the confidentiality of your account information, and you agree to immediately notify Jovial Store of any unauthorized use of your account information or any other breach of your confidential information.
2. Jovial Store will not be liable under any circumstances for any loss you may incur, directly or indirectly, morally or materially, as a result of the disclosure of your account information.
3. You agree to use your Jovial Store account or membership yourself, as you are fully responsible for it. If someone else uses it, you will bear the consequences of any losses or misuse, since you have authorized them to use the store in your name and on your behalf.
4. You agree to use the Jovial Store with complete seriousness and integrity.
5. You agree to provide true, accurate, up-to-date, complete, and legal information about yourself as required during registration with Jovial Store, and you agree to update your information if it changes or if necessary.
6. Jovial Store is committed to handling your personal information and contact details with the utmost confidentiality.
7. If Jovial Store determines that you have provided false, inaccurate, outdated, incomplete, illegal, or otherwise unauthorized information, or information that violates the Terms of Use, Jovial Store reserves the right to suspend, freeze, or terminate your membership and account on the platform. This will not prejudice Jovial Store's other rights and legitimate means of recourse to recover its rights and protect other users.
8. In the event of non-compliance with any of the above, Jovial Store management has the right to suspend or terminate your membership or block your access to Jovial Store services.
Article Six - Electronic Communications and Official Communication Channels:
1. The parties to this agreement agree that communication will be conducted via email, the WhatsApp number registered on the platform, the telephone number, or social media platforms.
2. The user agrees that all data and communications provided electronically are equivalent to written documents and constitute valid and legally binding evidence.
3. The user agrees to be contacted and notified of any provisions related to this agreement or their dealings with the Jovial Store through general messages broadcast to all users or specific users of the Jovial Store.
Article Seven - Amendments to the User Agreement and Fees:
1. Jovial Store may notify you of any amendments to this agreement through the official communication channels stipulated herein.
2. If you object to any amendment to the User Agreement, Jovial Store requests that you cease using its services. Your continued access to your Jovial Store account or use of the Jovial Store constitutes your acceptance of the amendments and your full and complete agreement, without reservation. Jovial Store welcomes discussion of any suggestions regarding these terms.
3. All fees are calculated in Saudi Riyals. The user is responsible for paying all applicable platform fees, in addition to any other expenses added by Jovial Store. Payment must be made through the approved and specified methods available through Jovial Store.
4. Jovial Store may charge fees to certain users based on the offers, products, or services they request, or based on any applicable government fees or taxes related to the nature of the product or service.
5. Jovial Store reserves the right to add, increase, decrease, or deduct any fees or expenses in accordance with the terms and conditions of the User Agreement for any user, regardless of their reason for registration.
Article Eight – Jovial Store Payment and Settlement Services:
1. Jovial Store, through its partners, provides a payment and settlement system within the Jovial Store, which can be completed entirely online through the payment options available on the Jovial Store.
2. Jovial Store is committed to setting the price of the service or product it offers in its store according to the prevailing market value.
3. Jovial Store is committed to providing invoices for all amounts and profits generated in its store and to providing the user with an invoice for their purchase of a service or product from Jovial Store.
4. Jovial Store is committed to providing the accounting standards commonly accepted in its online store in accordance with the provisions of this Agreement and in consideration of the legal, economic, commercial, and regulatory interests involved in this arrangement.
Article Nine - Your Personal Information and Transaction Details:
1. The user acknowledges granting Jovial Store an unlimited, worldwide, perpetual, irrevocable, royalty-free, and transferable right to use any personal or other information or materials provided or supplied to the Jovial platform, or published on the platform through registration or use, via the designated communication and registration forms, email, or any other communication channels available on the platform, for the purpose of achieving any interests deemed appropriate by the platform.
2. The provisions regarding the confidentiality of consumer information are subject to the Jovial Store's "Privacy and Confidentiality Policy" and the provisions of this agreement related to confidentiality.
Article Ten - Intellectual Property:
1. Jovial Store's intellectual property rights are fully owned by Jovial Store, whether acquired before or after the establishment of this online platform.
2. The user or consumer respects the intellectual property rights of Jovial Store, including the Jovial Store itself, its words, logos, and other symbols, whether displayed on the Jovial Store website or otherwise. Jovial Store and all rights pertaining to it are the full intellectual property of Jovial Store.
Article Eleven - Jovial Store's Responsibility:
1. Jovial Store is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
2. Jovial Store is not liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, or through the user or a third party such as shipping companies.
3. Jovial Store, its employees, owners, and representatives are committed to ensuring that the product or service is sound, legal, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Twelve – Confidentiality of Information:
1. Jovial Store employs tangible, organizational, and technical measures to protect users and prevent unauthorized access to and storage of users' personal information.
2. As a user, you acknowledge that the internet is not a completely secure medium, and the confidentiality of your personal information cannot be 100% guaranteed through Jovial Store.
3. Jovial Store has no control over the actions of any third party, such as other websites linked to the platform or third parties claiming to represent you or others.
4. You understand and agree that Jovial Store may use the information you provide to offer you services within the Jovial Store and to send you marketing messages. Jovial Store's privacy policy governs the collection, processing, use, and transfer of your personal information and is subject to the confidentiality rules outlined in Jovial Store's "Privacy and Confidentiality Policy."
Article Thirteen - Restriction of Access or Membership:
Jovial Store may suspend or terminate a user's membership or restrict a user's access to the platform's services at any time, without notice, for any reason whatsoever.
Article Fourteen - Applicable Law or Regulation:
This User Agreement is governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is subject to the regulations of the authorities in the Kingdom of Saudi Arabia.
Article Fifteen - General Provisions:
• If any article or clause in this User Agreement is canceled or becomes invalid, this shall not affect the validity of the remaining articles, clauses, and provisions, which shall remain in effect until further notice from the Jovial Store management.
• This User Agreement – which may be amended from time to time as necessary – constitutes the agreement, operating mechanism, understanding, and contract between the Jovial Store and the user. Both parties to this agreement agree to the following:
1. Arabic shall be the governing language for interpreting the provisions of this agreement, or when translating it into another language.
2. All prices displayed for Jovial Store services or products may be modified from time to time.
3. Promotional or marketing offers made by Jovial Store are temporary. Jovial Store reserves the right to modify or discontinue these offers at any time.
Jovial Store reserves the right to issue or discontinue promotional codes at any time as needed.
4. The parties to this agreement undertake to conduct their dealings in accordance with Sharia principles and applicable laws and regulations relevant to the nature of the relationship between Jovial Store and the user.
5. This User Agreement may only be terminated by a decision issued by Jovial Store management.
